The Appeals Court is Built as a Safety Net to Prevent Wrongful Convictions

Part of the reason for guaranteeing an appeal is so that people who feel that they were convicted for a crime they did not commit can have a second shot at proving their innocence. A case in the court of appeals is focused mainly on presenting new evidence and pointing out flaws in the previous case.

The hope is that there will be fewer wrongful convictions because those who have been convicted but should not have been will be able to prove their innocence with more time to gather evidence and present it to a new judge. This also makes it less likely that a person is convicted based on a personal bias one judge has. The idea of the appeals court is to make the system more just.

Obtaining a Prison Transfer So You Can Move Closer to Home

This means that you may be sent to a prison that is far away from everyone that you care about. You will not typically be sent overly far away since prisons often feel that contact with family is good for the rehabilitation of an individual.

After you have spent a few months in a prison, you are allowed to ask for a prison transfer. Most commonly a transfer will only be allowed if you can show that one is truly necessary. Family and friends can write to a Prison Governor after a prisoner applies for a transfer to show their support of the transfer. It also may be helpful to get notes from doctors or teachers explaining why a transfer would benefit the family.
